Do You Need a Permit to Sell Door to Door? Permits, Licenses and the Rules That Apply

Solicitor permits, state licenses, No Soliciting signs, the FTC three-day cancellation rule and other door-to-door sales laws, explained for reps.

Short answer: often, yes. Many cities and counties require door-to-door sellers to register for a solicitor or peddler permit, and some states license reps in specific industries such as home security, home improvement and retail energy. Your company should handle the paperwork, but you are the one at the door, so know the basics: carry your permit and ID, respect No Soliciting signs where the town enforces them, knock only during allowed hours, and give customers the cancellation notice federal law requires.

Local solicitor permits

Permit rules are set by each city or county, so they change from one town to the next. A typical permit asks for your name, photo, the company you represent, and sometimes a background check and a fee. Some towns issue a badge you must wear. Towns with strict rules are sometimes said to have a "Green River ordinance," after Green River, Wyoming, which restricted door-to-door sales in the 1930s.

Courts have limited how far towns can go, and the rules for commercial sales differ from the rules for religious or political canvassing. For a sales rep the practical rule is simple: if the town requires a permit, work with one.

The federal three-day rule

The FTC's Cooling-Off Rule gives buyers three business days to cancel most sales of 25 dollars or more made at their home. The seller must tell the buyer about this right and give them a written cancellation form. Companies build this into their contracts. Never tell a customer they cannot cancel.

No Soliciting signs, hours and no-knock lists

Storm-state roofing rules

Several states, Texas and Colorado among them, make it illegal for a roofing contractor to waive, pay or rebate a homeowner's insurance deductible. Some states also limit what a contractor may do on the homeowner's claim. Storm teams that travel need to follow the rules of the state they are in, not the one they came from.

What to ask a company

  1. Who pulls the permits in each town, and who pays for them?
  2. Does my role need a state license, and will you sponsor it?
  3. How do you handle cancellations under the three-day rule?

This is general information, not legal advice. Rules change, so check with the town or state before you knock.

Questions

Do I need a permit to sell door to door?

In many cities and counties, yes. Solicitor or peddler permits are set locally, so the rules change from town to town. Your company should know which towns require one and help you get it.

Can I knock on a door with a No Soliciting sign?

In many towns it is an offense, and it is bad sales either way. Skip posted homes.

Can customers cancel a door-to-door sale?

Yes. The FTC Cooling-Off Rule gives buyers three business days to cancel most sales of 25 dollars or more made at their home, and the seller must give them a cancellation form.

Do home security reps need a license?

In many states, yes, often with a background check and fingerprints. The company usually sponsors the license.
